COTC Cover: Why Every Waste Site Needs a Contingency Plan

Most permitted waste site operators understand they need a Technically Competent Manager. Far fewer have a plan for what happens when that person isn't available. This guide explains why that gap is a serious risk — and what COTC Cover is.

What Is a TCM and Why Is One Required?

A Technically Competent Manager (TCM) is a qualified professional responsible for the day-to-day management of a permitted waste site. UK environmental law requires every permitted waste site to have a TCM on site at all times during operational hours.

The TCM must hold the appropriate WAMITAB Certificate of Technical Competence (COTC) for the types of waste management activities being carried out on the site. Different waste activities require different COTC qualifications — a manager qualified for one type of site may not be qualified for another.

This requirement isn't optional or advisory. It is a condition of your environmental permit. Operating without a qualified TCM present is a direct breach of that permit.

What Happens If Your TCM Is Unavailable?

This is the question most operators don't want to think about — but must. If your TCM is unavailable and you have no qualified cover in place, your site cannot legally operate. The options are:

  • Stop operating The site closes until a qualified TCM is available. Every day of closure has a direct financial cost — lost revenue, fixed costs still running, contracts potentially at risk.
  • Operate without cover Some operators choose to continue operating, assuming the EA won't find out. This is a direct permit breach with serious consequences if discovered — including permit suspension or revocation.
  • Have COTC Cover in place A pre-arranged agreement with a qualified provider means cover can be deployed quickly, with no gap in compliance and no disruption to operations.

When Do Sites Typically Need Cover?

TCM absence happens more often than you might expect, and not always at convenient times:

  • Annual leave — your TCM is entitled to holidays like everyone else
  • Sick leave — illness is unpredictable, often with no notice
  • Maternity or paternity leave — extended absence that can last months
  • Resignation or dismissal — interim cover may be needed for weeks or months while you recruit
  • Emergency — same-day absence with no warning
  • Seasonal demand — some sites have variable operational requirements

The most dangerous scenario is unexpected sick leave or resignation with no notice. Without a pre-arranged cover agreement, you are making emergency calls to find a qualified TCM while your site is already in breach.

What Is COTC Cover?

COTC Cover is a formal arrangement with a qualified, WAMITAB-certified provider who can step in as TCM for your site when your own manager is unavailable. The provider takes on the legal TCM responsibilities for the site for the duration of the cover period.

A good COTC Cover arrangement is set up in advance — not at the moment of crisis. This means the provider already knows your site, your permit conditions, and your operations, so they can step in effectively from day one.

What Should You Look for in a Provider?

  • WAMITAB qualifications covering the waste activities on your specific site — not all COTCs are the same
  • Experience of your permit type and the EA's expectations
  • Ability to provide cover at short notice, including same-day emergencies
  • Willingness to familiarise themselves with your site before they're needed
  • A clear contractual arrangement so responsibilities are documented

The Cost of Not Having Cover

The financial cost of a site closure — even for a few days — almost always exceeds the cost of a COTC Cover arrangement. Add to that the regulatory risk of operating without a TCM, and the calculation becomes straightforward.

More importantly, if the EA discovers you operated without a TCM, the consequences go beyond a fine. Repeated or serious permit breaches can trigger a permit review — putting your ability to operate at all at risk.
